Key rights under Directive (EU) 2015/2302

  • Travelers will receive all essential information about the package tour before entering into the package tour contract.

  • There is always at least one service provider responsible for ensuring that all travel services included in the contract are performed correctly.

  • Travelers are provided with an emergency phone number or information about a contact point where they can reach the tour operator or travel agency.

  • Travelers may transfer their package tour to another person, provided they give reasonable notice and, if applicable, pay an additional fee.

  • The price of the package tour may only be increased if specific costs rise (such as fuel prices), and if this is expressly stated in the contract, and in any event no later than 20 days before the start of the package tour. If the price is increased by more than 8% of the price of the package tour, the traveler may terminate the contract. If the organizer reserves the right to increase the price, the traveler is entitled to a price reduction if the relevant costs decrease.

  • Travelers may cancel the contract without paying a cancellation fee and receive a full refund of all payments if any essential element of the package tour other than the price is significantly altered. If the trader responsible for the package tour cancels the package tour before it begins, travelers are entitled to a refund and compensation, where applicable.

  • Under exceptional circumstances, travelers may cancel the contract before the start of the package tour without paying a cancellation fee, for example, in the event of serious security issues at the destination that are likely to affect the package tour.

  • In addition, travelers may cancel the contract at any time before the start of the package tour, subject to a reasonable and justified cancellation fee.

  • If significant parts of the package tour cannot be provided as agreed after the tour has begun, suitable alternative arrangements must be offered at no extra cost. Travelers may terminate the contract without paying a cancellation fee if the services are not provided as agreed, this significantly affects the performance of the package tour, and the organizer fails to remedy the problem.

  • Travelers are also entitled to a price reduction and/or compensation for damages if travel services are not provided or are provided inadequately.

  • The organizer must provide assistance if the traveler is in difficulty.

  • If the organizer or, in certain Member States, the retailer becomes insolvent, payments will be refunded. If the organizer or, where applicable, the retailer becomes insolvent after the package tour has begun and if transportation is included in the package tour, the travelers’ return transportation will be ensured.
